HOA Documents

In order to be a recognized homeowners’ association, the association must be a Florida corporation; incorporated and official. Hierachy of Documents Governing Homeowner Associations in Florida

1. Florida Statutes: The top level of authority, providing the framework for community associations.
2. Declaration of Covenants, Conditions, and Restrictions (CC&R): The primary governing document outlining the rights and responsibilities of the association, unit owners, and board of directors.
3. Articles of Incorporation: Establishes the community association as a corporation under Florida law.
4. Bylaws: Governs the internal affairs of the community, including meeting procedures and officer elections.
5. Rules and Regulations: Created by the board of directors to supplement the CC&R and bylaws, covering issues like common area use, parking, and pet policies.

If there is a conflict between any of these documents, the higher document takes precedence. For example, if there is a conflict between a rule adopted by the board of directors and the CC&R, the CC&R takes precedence. It is crucial for homeowners and board members to be familiar with all relevant documents to understand their rights and responsibilities within the community.

In Florida, homeowners’ association laws are derived from Statutes 720. Commonly referred to as simply HOA laws, these encompass everything from homeowner association dues to board meetings and regulations.
